TERMS AND CONDITIONS OF USE

Free nature of access and use of the website: the services provided by Improfit are free of charge for all users.

The user warrants the authenticity of the data communicated. It shall be the user’s responsibility to keep the information provided to Improfit permanently up to date so that it reflects, at all times, their actual situation. The user shall be solely responsible for any false or inaccurate statements they make and for any damages caused to the provider or to third parties.

The user undertakes to use the website in accordance with the law and this Legal Notice. The user shall refrain from using the website for unlawful or prohibited purposes, or for purposes that are harmful to the rights and interests of third parties, or that may in any way damage, disable, overload, deteriorate or prevent the normal use of computer equipment or documents, files and all kinds of content stored on any of the provider’s computer equipment.

Improfit is a tele-rehabilitation platform classified as Software as a Medical Device (SaMD). The platform is exclusively instrumental in nature and serves as a support tool for healthcare professionals. It in no case replaces clinical judgement, medical diagnosis or therapeutic prescription. The metrics, reports and feedback generated must always be interpreted by a qualified healthcare professional.

The use of the platform by patients without the supervision of a healthcare professional is the sole responsibility of the user. Improfit shall not be liable for any damages that may arise from unsupervised use or from use contrary to the instructions of the treating professional.

DISCLAIMER OF WARRANTIES AND LIABILITY

The owner disclaims any liability arising from information published on our website, provided that such information has been manipulated or introduced by an unrelated third party.

This website has been reviewed and tested to operate 365 days a year, 24 hours a day. However, Improfit does not rule out the possibility of certain programming errors, or the occurrence of force majeure events, natural disasters, strikes or similar circumstances that make access to the website impossible.

• Not cause damage to the physical or logical systems of the platform, its providers or third parties.
• Not introduce or disseminate computer viruses or any other physical or logical systems that may cause damage to the systems of Improfit, its providers or third parties.
• Refrain from accessing, using and/or manipulating the data of Improfit, third-party providers or other users of the platform.
• Not reproduce, copy, distribute, publicly communicate, transform or modify the content, unless with the express authorization of the owner or where legally permitted.
• Not suppress, hide or manipulate the notices regarding intellectual or industrial property rights and other identifying data of the rights of Improfit or third parties incorporated into the content.
• Use the platform exclusively within the clinical scope for which it was designed. Since Improfit is a Software as a Medical Device (SaMD), its use for purposes other than tele-rehabilitation and support for the healthcare professional is expressly prohibited.
• If, in order to access certain services and/or content on the platform, a password is provided, the User undertakes to use it diligently, keeping it secret at all times. Accordingly, the User shall be responsible for its proper safekeeping and confidentiality, and undertakes not to transfer it to third parties, whether temporarily or permanently, nor to allow access to the services and/or content by unauthorized persons.
• The User undertakes to notify Improfit of any event that may involve improper use of their password, such as theft, loss or unauthorized access, by writing to info@improfit.ai, in order to proceed with its immediate cancellation. Until such notification is made, Improfit shall be exempt from any liability that may arise from the improper use of the password.

APPLICABLE LAW AND JURISDICTION

For the resolution of any disputes or matters relating to this website or to the activities carried out on it, Spanish legislation shall apply, to which the parties expressly submit, with the Courts and Tribunals of the city of Barcelona being competent to resolve all disputes arising from or related to its use.
