WELLFIT TEC, SL (hereinafter, Improfit) aims to respect the privacy of its users and protect the personal data they may provide to Improfit.

In compliance with Spanish Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the safeguarding of digital rights (hereinafter, LOPDGDD) and the European Union’s General Data Protection Regulation (hereinafter, GDPR), this data collection activity will be governed by the terms described below.

Purpose of the information

Depending on the use you make of the platform, Improfit may process the following types of personal data:

Identifying data (for example, first name, surname, email, username, name of the centre, etc.).
Health data (for example, pathology or clinical condition, movement metrics, history of rehabilitation sessions).
Connection and browsing data (access logs, date and time of connection).

Improfit reminds users that some of the personal data requested in order to grant access to certain functionalities or services of this platform will be mandatory, as they are essential for providing the service. The rest are optional and are left to the discretion of the healthcare professional or the user.

The personal data collected through the platform will be used for the following purposes:

PROVISION OF THE SERVICE	To process the personal data strictly necessary to manage access to the platform, patient management, the monitoring of therapeutic exercises and the generation of clinical reports for the healthcare professional.
PROCESSING OF HEALTH DATA	To process the patient’s health data (pathology, movement metrics and clinical history) in order to deliver the tele-rehabilitation service prescribed by the healthcare professional.
IMPROVEMENT AND RESEARCH	Use of anonymised data to improve the platform, train movement analysis models and conduct internal research.

The user guarantees that the data provided is truthful and up to date. Improfit may restrict access when it detects false or inaccurate information, without prejudice to any legal liability that may arise.

Legal basis

The table below sets out the legal basis underpinning each of the personal data processing activities carried out by Improfit:

PROVISION OF THE SERVICE	We process this data because it is necessary to perform the service contract with the healthcare professional or clinical centre.
PROCESSING OF HEALTH DATA	We process this data with the express consent of the patient, obtained by the healthcare professional prior to registration on the platform. The professional certifies that they have informed the patient and obtained their authorisation through the relevant checkboxes on the platform.
IMPROVEMENT AND RESEARCH	We only process this data if the patient has given their express authorisation, separately. Such authorisation is entirely voluntary and may be withdrawn at any time with no consequences for the service.

Data retention periods

Personal data will be kept for the time strictly necessary, depending on the purpose for which it was collected:

PROVISION OF THE SERVICE	Data will be kept for as long as the relationship with Improfit is maintained. Once it ends, identifying data will be deleted or anonymised within the established time frames.
PROCESSING OF HEALTH DATA	The patient’s clinical data will be kept for as long as the therapeutic relationship lasts. Once it ends, the data will be anonymised or deleted.
IMPROVEMENT AND RESEARCH	Once anonymised, the data may be kept indefinitely, as it no longer constitutes personal data. Consent may be withdrawn at any time.

In order to provide the services described, Improfit may share personal data with third parties acting as data processors, bound by the relevant contracts, such as:

Technology service providers.
Service providers related to the administration of Improfit.

Your rights

Access: To know what data of yours Improfit is processing.
Rectification: To correct inaccurate or incomplete data.
Erasure: To request the deletion of your personal identifying data.
Restriction: To request that processing be restricted in certain circumstances.
Objection: To object to the use of your data for secondary purposes.
Portability: To receive your data in a structured, commonly used format.
To lodge a complaint with the Spanish Data Protection Agency (www.aepd.es).

You may exercise your rights by sending a request by email to info@improfit.ai, stating the right you wish to exercise.

The maximum response time is one month from the receipt of the request, extendable by a further two months when the complexity or number of requests so requires, with notification of the extension within the first month.

Minors

In order to use the services, minors must always first obtain the consent of their parents, guardians or legal representatives, who are ultimately responsible for all acts carried out by the minors in their care. Responsibility for determining the specific content accessed by minors lies with them; if content unsuitable for the Internet is accessed, mechanisms should be set up on their computers — in particular software, filters and blockers — to limit the available content. Although not foolproof, these are especially useful for monitoring and restricting the materials that minors can access.

Security applied to personal data

In order to ensure the security and integrity of any personal data provided, Improfit has adopted the necessary technical and organisational measures to prevent the loss of data, as well as unauthorised processing or access by third parties.

Changes to the privacy policy

We reserve the right to modify or adapt this Privacy Policy at any time. We recommend that you review it periodically to stay up to date.
